Welcome to Babalu Hair Haus! We're pleased to offer our customers the convenience of layby. Below are the terms and conditions that apply to all layby agreements. By entering into a layby agreement with us, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
1. Layby Agreement

A layby agreement is a contract between Babalu Hair Haus ("we", "us", "our") and the customer ("you", "your") for the purchase of goods with payment to be made over an agreed period.

The layby period is 12 weeks maximum from the date of the agreement.
2. Deposits and Payments

A non-refundable deposit of 20% of the total purchase price is required to initiate the layby.

Regular payments must be made at intervals agreed upon at the start of the layby.

Payments can be made in-store or via our online payment system or through bank transfer.
3. Payment Schedule
-
The payment schedule will be agreed upon at the time of initiating the layby and documented in the layby agreement.

You must adhere to the payment schedule. Failure to make payments as scheduled may result in cancellation of the layby.

The layby payment option is available for services or products for value equal and over $1000.
4. Collection of Goods

The service or goods will be available for collection only after the full payment has been made.

Once full payment is received, you will be notified, and the service or goods must be collected within 30 days.
5. Cancellation and Refunds

You may cancel your layby at any time before the final payment is made.

If you cancel the layby, we will refund the amount paid, less the non-refundable deposit.

If you fail to complete the layby agreement or miss two consecutive payments without prior arrangement, we reserve the right to cancel the layby and refund the amount paid, less the non-refundable deposit.
6. Changes to Layby Agreements

Changes to the layby agreement, including changes to the payment schedule, must be agreed upon in writing by both parties.

Requests for changes can be made by contacting us in-store or via our customer service contact details.
7. Non-Collection

If the goods are not collected within 30 days after the final payment, we will attempt to contact you.

If the goods remain uncollected after 60 days from the initial contact attempt, the layby will be considered cancelled and a refund will be issued, less the non-refundable deposit.
8. Consumer Rights

This layby agreement is in accordance with the Australian Consumer Law.

Your rights under the Australian Consumer Law are not limited by this agreement. For more information about your rights as a consumer, visit the Australian Competition and Consumer Commission (ACCC) website.
